1. Acceptance of Terms
Welcome to Harishya Infratech LLP. By accessing our official website, utilizing our online consultation and quotation tools, or entering into turnkey contracting engagements with our firm, you acknowledge and agree to comply with and be bound by these Terms of Service.
If your organization represents a corporate body, public department, or contractor, you affirm that the individual agreeing to these terms holds requisite legal authority to bind that entity to contractual commitments with Harishya Infratech LLP.
2. Scope of Engineering Services
Harishya Infratech LLP provides specialized engineering, procurement, construction (EPC), installation, testing, and annual maintenance services across six primary verticals:
- Electrical Solutions: HT/LT sub-stations, industrial power distribution switchgear, control panels, wiring, and high-efficiency LED street lighting networks.
- Water Treatment: Commercial and industrial Reverse Osmosis (RO) plants, water softening, multi-stage filtration, and mineral replenishment.
- Effluent & Wastewater (ETP/CTP): Effluent Treatment Plants, Common Treatment Plants, and zero-liquid-discharge (ZLD) systems.
- Industrial Filtration: Dual media filters, activated carbon filtration, and automatic backwash plants.
- Turnkey Commissioning: Full site erection, mechanical preparation, load balancing, statutory approvals, and handover.
- AMC Operations: 24/7 technical assistance, scheduled preventive visits, and emergency spare replacement.
3. Quotations, Estimates & Milestone Payments
All commercial quotations generated through website consultations or field site assessments represent formal estimates based on client-provided specifications. Definitive project pricing and delivery timelines are formalized via execute Purchase Orders (PO) or Work Contracts.
- Quotations remain valid for 30 calendar days from issuance unless otherwise specified in writing.
- Turnkey projects are billed on structured progress milestones (e.g. Design Approval, Component Procurement, Erection, Load Testing, Final Handover).
- All commercial transactions are subject to statutory GST and applicable Indian taxation.
4. Site Access, Clearances & Safety Compliance
For on-site electrical installation, civil foundation preparation, and plant commissioning, the client agrees to:
- Provide unimpeded, safe site access to Harishya engineers, technicians, and specialized machinery.
- Procure all necessary local municipal, environmental, or electrical grid interconnection permissions unless explicitly designated under our turnkey scope.
- Ensure a hazard-free work perimeter conforming to the Occupational Safety and Health (OSH) standards.
5. Intellectual Property & Technical Drawings
All intellectual property rights relating to the Harishya Infratech LLP website, branding, visual assets, proprietary engineering calculators, and custom Single Line Diagrams (SLD) remain the sole property of Harishya Infratech LLP.
Project-specific design schematics furnished to clients remain protected under copyright law and may not be transferred or duplicated for execution by unapproved third-party contractors without prior written consent.
6. Equipment Warranties & AMC Operations
All installed equipment is backed by standard Original Equipment Manufacturer (OEM) warranties against manufacturing defects. In addition, Harishya provides workmanship warranties and comprehensive Annual Maintenance Contracts (AMC):
- Warranties do not cover failures resulting from improper client operation, voltage fluctuations beyond permissible tolerances, unauthorized tampering, or natural disasters.
- AMC contracts include scheduled preventive maintenance inspections, priority breakdown support, and discounted spares.
7. Limitation of Liability
To the maximum extent permitted by applicable Indian law, Harishya Infratech LLP shall not be liable for indirect, incidental, special, or consequential damages (including business interruption or production downtime) resulting from grid power surges, third-party municipal water supply disruptions, or force majeure events.
8. Governing Law & Dispute Resolution
These Terms of Service and all related engineering agreements shall be governed by and construed in accordance with the laws of the Republic of India.
Any legal dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts in Kushinagar, Uttar Pradesh.
